Section 7
Special provision regarding registration of land
–
(1) When setting up the registration book according to sub-section (2) of section 6, if there is an exemption for surveying a piece of land under the Land (Examination of Survey) Act, 2019, the land office shall take the consent of the surveying department and make a survey map of that land and register it on the recommendation of the appointed committee. (1a) Notwithstanding anything written in other sections of this Act, if the Government of Nepal deems it necessary to solve the problems arising for the purpose of registering the land of any person, class or region, the Government of Nepal shall publish a notice in the Nepal Gazette and have a chairman and a maximum of four members to decide on land registration. A commission or a committee may be formed and the work, duties and rights of that committee or commission shall be as prescribed in the constitution of that commission or committee.
(2) According to the Land (Survey) Act, 2019, if any land with a survey map is exempted from registration, the land office may register such land by following the procedure prescribed by the recommendation of the committee after conducting the necessary investigation including the pre-registration, title and enjoyment of the said land. Regarding such registration, the shipping office should make a final decision within two years from the date of the application.
(3) If the name, surname, nationality, age of the land owner, or the name of his father, son, husband or father-in-law or the lot number, area or type of the land is different, or if there is a double registration, the land office can correct the matter after making necessary checks and maintain the registration.
